1. Acceptance of terms
These Terms of Service ("Terms") govern access to and use of D15 AI Marketing (the "Service"), including related websites, applications, and APIs. By creating an account, signing in, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of the Service
D15 AI Marketing is a software platform that helps users plan, create, edit, schedule, and publish marketing content, and connect social-media or messaging accounts for managed publishing and related workflows. Features may include content planning, media upload and editing, AI-assisted drafting or generation, publishing tools, analytics views, and administrative integrations.
The Service may change over time as features are added, improved, or removed. Availability of any specific feature is not guaranteed.
3. Accounts and responsibilities
You are responsible for:
- providing accurate account information;
- maintaining the confidentiality of your login credentials;
- all activity that occurs under your account; and
- ensuring that users you invite or authorize comply with these Terms.
Notify the Service administrator promptly if you suspect unauthorized access to your account.
6. User-provided and uploaded content
You retain ownership of content you upload or submit to the Service ("User Content"), including media files, captions, brand materials, and similar materials. You grant D15 AI Marketing a limited license to host, process, transmit, display, and otherwise use User Content solely as needed to operate and provide the Service you request.
You represent that you have all rights necessary for User Content and that it does not infringe others' rights or violate applicable law.
7. Responsibility for content
You are responsible for the content you create, approve, and publish with the Service, including text, prices, offers, contact details, images, and logos, and for making sure it is accurate, lawful, and compliant with the rules of each platform where it is published.
8. AI-generated content
The Service may use artificial intelligence or automated tools to help draft, transform, suggest, or generate text, media-related outputs, or other materials ("AI Outputs"). AI Outputs may be inaccurate, incomplete, biased, or unsuitable for your use case. You are solely responsible for reviewing AI Outputs before publishing or relying on them.
Unless otherwise agreed in writing, AI Outputs are provided for your business use in connection with the Service, subject to these Terms and any third-party platform rules that apply when you publish.
9. Third-party platforms and services
The Service depends on third-party platforms, hosting providers, and APIs. D15 AI Marketing is not responsible for outages, policy changes, rate limits, permission denials, content removals, or other actions by third parties. Your use of third-party services remains subject to those providers' terms and privacy policies.
10. Acceptable and prohibited use
You agree not to use the Service to:
- violate applicable laws or regulations;
- infringe intellectual property, privacy, or publicity rights;
- upload malware, attempt unauthorized access, or disrupt the Service;
- spam, harass, deceive, or publish content that platforms prohibit;
- misuse OAuth tokens, scrape the Service improperly, or bypass usage limits; or
- use the Service in any way that could harm D15 AI Marketing, its users, or connected platforms.
11. Subscriptions and billing
Some features of the Service may be offered under paid plans, subscriptions, or usage-based arrangements. Pricing, billing cycles, and commercial terms—if applicable—will be presented separately at the time of purchase or in an order form or agreement. These Terms do not establish specific prices.
Unless stated otherwise in a separate commercial agreement, fees are non-refundable except where required by law.
12. Service availability
We aim to keep the Service available and useful, but we do not guarantee uninterrupted, error-free, or continuous operation. The Service may be suspended temporarily for maintenance, security, capacity, or circumstances beyond our reasonable control, including third-party outages.
13. Intellectual property
The Service—including software, design, branding, documentation, and related materials—is owned by D15 AI Marketing or its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.
You may not copy, modify, reverse engineer, or create derivative works of the Service except as permitted by law or written agreement.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, D15 AI MARKETING DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that AI Outputs, analytics, or publishing results will meet your expectations or that third-party platforms will accept or retain published content.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, D15 AI MARKETING AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID TO USE THE SERVICE DURING THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (US$100) IF YOU HAVE NOT PAID ANY AMOUNTS DURING THAT PERIOD.
Some jurisdictions do not allow certain limitations; in those cases, the limitation applies to the fullest extent permitted.
16. Suspension and termination
We may suspend or terminate access to the Service if you materially breach these Terms, create security or legal risk, fail to pay applicable fees, or if we discontinue the Service. You may stop using the Service at any time and may request account closure through the available account or administrative channels.
Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and indemnity-like obligations where applicable.
17. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page will change when updates are posted. Continued use of the Service after updates become effective constitutes acceptance of the revised Terms, except where additional consent is required by law.
18. Contact
Questions about these Terms may be directed to the D15 AI Marketing account administrator or the contact channel provided with your account or service agreement. This page does not list a separate public mailing address or phone number.
4. Social account connections
The Service may allow you to connect third-party platforms (for example TikTok, Instagram, YouTube, Facebook, LinkedIn, and similar services) through OAuth or other authorization flows provided by those platforms.
By connecting an account, you confirm that:
You may disconnect connected accounts through the Service where that option is available, and you may also revoke access from the third-party platform's security or app settings.
